Part III. What Personal Information Does Fluxergy EU Collect

Fluxergy EU does not collect any personal information through our website.

Fluxergy EU will collect contact details from current customers, prospective customers, employees and business partners(suppliers, logistics companies, etc), such as contact details and preferences, such as your name, email, postal address, and phone number. Payment details required for processing transactions, like credit card numbers or account information.

Fluxergy EU only gathers information about users through necessary cookies. The legal basis for the processing of data using technically necessary cookies, e.g. to implement the functions you have selected or to safeguard our legitimate interest in the functionality of the online offer, is based on Art. 6 para. 1 lit. b) and f) GDPR.

Part V. HOW LONG DOES FLUXERGY EU RETAIN INFORMATION?

We retain data only for as long as necessary to fulfill purposes for which it was collected, ensuring it is adequate, relevant and limited to those purposes, in line with our records retention program. However, we may retain data for a longer retention period if required by law, or if necessary to resolve disputes or protect our legal rights, as per Articles 5(1) of the GDPR and UK GDPR. 

When determining retention periods, we consider the following: 

  • Legitimate Interests: Data is retained for a reasonable period, balancing our interests and the fundamental rights of data subjects. 
  • Contractual Necessity: Data is retained for the duration of the contract and any additional period required to fulfill legal obligations or handle potential claims. 
  • Legal Obligations: Data is retained for the duration mandated by applicable laws. 
  • Consent: Data is retained as long as necessary to fulfill the purposes for which consent was given, with individuals retaining the right to request erasure under certain conditions. 

Part VI. CROSS BORDER TRANSFER POLICY

Please note that by accessing Fluxergy EU Services, you are sending data to the EEA, and such data will be stored in the EEA. Fluxergy does not transfer data outside of the EEA, unless customers request services from one of our affiliates located in the US, in which case we may transfer your data to such affiliate. 

When personal data must be transferred outside of the EU/EEA, Fluxergy EU relies on Standard Contractual Clauses (SCCs). SCCs are legal agreements approved by the European Commission that ensure your data receives GDPR-level protection in countries that do not have equivalent data protection laws.

This approach complies with Article 46(2)(c) of the GDPR, which allows for secure data transfers using SCCs.

Fluxergy EU takes measures to secure our Services; however, we cannot guarantee the confidentiality of information transmitted over the Internet. We encourage you to use caution when sharing personal information online, especially health-related data. Fluxergy EU cannot guarantee against unauthorized third-party access to your information. Therefore, please consider both the benefits and risks when submitting personal information to Fluxergy EU via email.

Fluxergy EU Services may contain links to third-party websites not controlled by Fluxergy EU or subject to this Privacy Notice. We recommend checking the privacy policies of these external sites before submitting personal information.

  1. You have the right to receive free information and confirmation from us at any time about the personal data stored about you and a copy of this data.
  2. You have the right to rectification and/or completion if the processed personal data concerning you is incorrect or incomplete.
  3. You have the right to request the restriction of processing if one of the following conditions is met:
    1. The accuracy of the personal data is contested by you, for a period enabling us to verify the accuracy of the personal data.
    2. The processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead.
    3. We no longer need the personal data for the purposes of the processing, but they are required by you for the establishment, exercise or defense of legal claims.
    4. You have objected to the processing pursuant to Art. 21 para. 1 GDPR and it is not yet clear whether our legitimate reasons outweigh yours.
  4. You have the right to obtain the erasure of personal data concerning you without undue delay where one of the following grounds applies and insofar as the processing is not necessary:
    1. The personal data have been collected or otherwise processed for such purposes for which they are no longer necessary.
    2. You withdraw your consent on which the processing was based and there is no other legal basis for the processing.
    3. You object to the processing pursuant to Art. 21 (1) GDPR and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Art. 21 (2) GDPR.
    4. The personal data was processed unlawfully.
    5. The deletion of personal data is necessary to fulfill a legal obligation under Union law or the law of the Member States to which we are subject.
  5. You have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format. You also have the right to transmit this data to another controller without hindrance from us. In exercising this right, you also have the right to obtain that the personal data concerning you be transmitted directly by us to another controller, insofar as this is technically feasible. The freedoms and rights of other persons must not be impaired by this.
  6. You have the right to object at any time to the processing of personal data concerning you, which is “only” based on legitimate interests of us or third parties (Art. 6 para. 1 lit. f GDPR). In the event of an objection, we will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims.
  7. You have the right to withdraw your declaration of consent under data protection law at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
